Short Term Rental Rules and Regulations in Spain 

Executive Overview 

Spain regulates short-term rentals through a layered system: national registration, autonomous-community tourist licensing, municipal zoning or saturation rules, homeowners’ association restrictions, guest reporting, tax compliance, and consumer-safety obligations. Since 1 July 2025, short-term and tourist rental listings advertised through online platforms generally need a national rental registration number in addition to any regional tourist licence. Requirements vary substantially by autonomous community and municipality, so owners should confirm local rules before advertising, accepting bookings, or making investment assumptions. 

Key Compliance Requirements 

  • Confirm whether the property is legally eligible for short-term rental use under regional, municipal, building, and community rules. 
  • Obtain the applicable regional tourist accommodation licence or registration, such as VUT, HUT, ETV, VFT, VV, or the locally used equivalent. 
  • Register for the national short-term rental identifier through the relevant Spanish registry process and display the required number on platform listings where applicable. 
  • Check local planning rules, saturation zones, moratoria, municipal authorisations, and building-use restrictions. 
  • Review homeowners’ association bylaws and approvals, especially for properties in multi-unit buildings. 
  • Meet habitability, safety, accessibility, equipment, complaint-book, guest-information, and consumer-disclosure duties required in the relevant region. 
  • Collect and report guest identification data through the applicable public-security guest reporting system where required. 
  • Maintain tax records for rental income and local charges, including non-resident income tax where relevant.

Insurance Considerations 

  • Confirm that the building, contents, and civil liability policies expressly permit short-term tourist use. 
  • Request written confirmation that guest injury, third-party property damage, fire, water escape, theft, and accidental damage are covered. 
  • Check whether platform-provided protections are secondary, limited, or subject to exclusions; do not treat them as a substitute for local insurance. 
  • Assess employer or contractor liability if cleaners, maintenance staff, keyholders, or property managers access the property. 
  • Keep emergency contacts, claims procedures, policy numbers, and insurer notification timelines available to the owner and property manager. 
  • Review community, lender, mortgage, and lease conditions to confirm rental use does not invalidate cover or breach financing terms. 

Guest-Facing Website Copy Information 

Use clear, guest-friendly wording that confirms the accommodation is operated in accordance with applicable Spanish short-term rental rules. Include the regional tourist licence number and national rental registration number where required, maximum occupancy, check-in and check-out times, house rules, quiet hours, waste and recycling instructions, community conduct expectations, safety information, complaint-book availability, and emergency contacts. Avoid legal overpromising; state that requirements vary by region and that guests must provide required identification information before or at check-in.
