Short Term Rental Rules and Regulations in India  A practical compliance guide for owners, hosts, and property managers preparing to list a short-term rental in India. 

Executive Overview 

Short-term rentals in India are legal, but they are not governed by one national short-term rental statute. Compliance is layered: state tourism or homestay registration, municipal and police requirements, housing society or landlord permissions, guest identity records, foreign guest reporting, tax obligations, and insurance readiness all need to be checked before a property is listed.  The most important practical rule is to verify the property locally before launch. Requirements vary by state, city, property type, ownership structure, number of rooms, food service, guest profile, and whether the owner lives on-site. A property that qualifies as a homestay in one state may be treated as a guest house, serviced apartment, lodging house, or commercial accommodation in another. 

Key Compliance Requirements 

  • Confirm classification: Determine whether the property is a homestay, bed and breakfast, serviced apartment, guest house, hotel, or other lodging category under the applicable state and local rules. 
  • Check state tourism registration: Many tourism-focused states require or strongly expect registration through the state tourism department or district tourism office. 
  • Verify municipal permissions: Review local trade licence, zoning, property tax, signage, waste, water, fire, and building-use requirements. 
  • Obtain society, landlord, or lease consent: Apartments, gated communities, condominiums, and leased properties should have written permission before accepting paying guests. 
  • Maintain guest records: Keep government ID records and a guest register for all guests, subject to privacy and data-retention safeguards. 
  • Report foreign guests: Register as an accommodation provider and file Form C for foreign nationals within the prescribed timeline through the FRRO process. 
  • Assess GST and income tax: Monitor annual turnover thresholds, GST registration requirements, platform collection/remittance, TDS/TCS reporting, and income-tax classification.

Insurance Considerations Before Listing 

  • Confirm that the home, landlord, or property insurance policy allows short-term rental or paying-guest use. 
  • Ask for written confirmation or an endorsement covering guest injury, accidental property damage, theft, fire, water damage, and liability to third parties. 
  • Check if business interruption, loss of rent, malicious damage, staff injury, and contents cover are included or excluded. 
  • Do not rely only on a booking platform’s host protection program; treat it as supplemental and review its exclusions, claim limits, documentation requirements, and deadlines. 
  • Keep dated photos, inventory lists, maintenance records, guest rules, incident reports, and invoices to support any future claim.

Use guest-facing copy that is accurate, specific, and consistent with permits and house rules. Avoid promising anything that is not legally approved or operationally reliable. Recommended content includes: 
  • Property type, location, room count, maximum occupancy, check-in, and check-out windows. 
  • Whether the owner, caretaker, or manager is on-site or nearby. 
  • Guest identity verification requirements and foreign guest documentation requirements. 
  • House rules for noise, visitors, parties, smoking, pets, parking, waste, shared areas, and quiet hours. 
  • Safety information, emergency contacts, evacuation guidance, first-aid location, and relevant amenity risks. 
  • Meal availability, kitchen access, drinking water, local transport, accessibility limitations, and neighbourhood expectations. 
  • Licence or registration number if the applicable authority or booking platform requires it to be displayed.

  1. Map the property: Confirm ownership, lease rights, property type, number of rooms, zoning, society rules, and whether the owner will live on-site. 
  1. Confirm local rules: Check the state tourism department, municipal body, local police, tax adviser, and insurance broker. 
  1. Secure permissions: Obtain registrations, licences, NOCs, tax registrations if needed, insurance endorsements, and fire or food approvals where applicable. 
  1. Build the operations file: Create a compliance folder with certificates, approvals, guest register templates, Form C process, tax records, safety checklist, and renewal calendar. 
  1. Prepare the property: Complete safety equipment, signage, maintenance, cleaning standards, guest information, emergency contacts, and inventory records. 
  1. Draft compliant listings: Publish only accurate amenities, occupancy limits, house rules, guest ID requirements, licence details if required, and cancellation terms. 
  1. Soft launch: Accept a limited number of trial bookings, test check-in, guest verification, Form C workflow, housekeeping, neighbour impact, and issue resolution.
