Short Term Rental Rules and Regulations in Kansas  Operational compliance guide for owners, hosts, and property managers 

Executive Overview 

Kansas does not have one statewide short-term rental operating license. Before listing, owners should confirm the parcel jurisdiction, determine whether the property is in a city or unincorporated county area, and document every approval that applies.  At the state level, short-term lodging may be subject to Kansas retailers’ sales tax, local sales tax, and local transient guest tax where adopted. Marketplace platforms may collect some taxes on platform bookings, but owners remain responsible for confirming what is collected, what is not collected, and what must be remitted for direct bookings.

  • Confirm local authority. Verify whether the property is governed by a city, county, township, or special district and identify the correct planning, zoning, licensing, tax, fire, and code offices. 
  • Check zoning and land use. Confirm that short-term rental use is allowed at the property address and whether owner-occupancy, special use approval, parking, occupancy, spacing, or neighborhood notice rules apply. 
  • Obtain required licenses or permits. Some Kansas jurisdictions require a business license, home occupation approval, short-term rental license, special use permit, inspection, or annual renewal. 
  • Register and remit taxes. Confirm Kansas sales tax, local sales tax, and transient guest tax obligations, including whether platform bookings and direct bookings are handled differently.

Insurance Considerations Before Listing 

  • Confirm that the policy allows short-term rental or transient lodging activity; do not assume a standard homeowners policy covers guest stays. 
  • Ask whether a short-term rental endorsement, commercial package, landlord policy, umbrella liability policy, or separate host protection policy is needed. 
  • Review liability limits for guest injury, property damage, pool or hot tub exposure, pet stays, bicycles, fire pits, and other higher-risk amenities. 
  • Confirm coverage for loss of rental income, theft by guests, intentional damage, vacancy periods, and claims arising from direct bookings. 
  • Check whether the lender, HOA, property manager, co-owner, or platform must be named or notified. 
  • Keep certificates, declarations pages, endorsements, claim procedures, and emergency contact information in the compliance file. 

Guest-Facing Website Copy Information 

Guest-facing copy should be clear, accurate, and consistent with local approvals. Avoid promising amenities, occupancy, events, parking, or pet access that the property cannot legally or operationally support. Include concise sections for maximum overnight occupancy, check-in and checkout times, parking instructions, quiet hours, trash and recycling, smoking rules, pet rules, event or party restrictions, safety equipment, emergency contacts, accessibility notes, and cancellation terms. 

Owner Checklist 

  • Confirm ownership authority, lender consent, lease restrictions, HOA rules, and title limitations. 
  • Verify address-specific zoning and whether an STR permit, business license, inspection, or special use approval is required. 
  • Register for applicable taxes and determine how platform and direct-booking taxes will be reconciled. 
  • Secure insurance coverage suitable for short-term rental operations. 
  • Approve house rules, occupancy limits, pricing strategy, cancellation policy, and guest screening standards. 
  • Create a compliance folder for approvals, tax filings, insurance documents, inspections, photos, and maintenance records. 

Host or Property Manager Checklist 

  • Maintain copies of local permits, licenses, renewal dates, inspection reports, and emergency contacts. 
  • Prepare accurate listings and confirm that guest-facing copy matches approved occupancy, parking, quiet hours, pet rules, and amenity limitations. 
  • Document cleaning, maintenance, safety checks, and guest communications after each stay. 
  • Monitor neighborhood complaints, noise alerts, parking issues, and incident reports; escalate matters promptly to the owner. 
  • Track direct-booking revenue, platform reports, tax collections, refunds, and pass-through charges. 
  • Review regulations at least quarterly and before renewing licenses or expanding to additional properties.
