Massachusetts Rules

Short Term Rental Rules and Regulations in Massachusetts

Executive Overview

Massachusetts regulates short-term rentals through a layered framework: state registration and tax rules administered by the Massachusetts Department of Revenue, plus local city or town ordinances that may impose separate permits, inspections, zoning limits, occupancy rules, health and safety standards, and annual renewal requirements. A short-term rental generally means a residential accommodation rented for 31 consecutive days or less. Owners should verify both state and municipal requirements before accepting bookings, because local rules may be more restrictive than statewide rules.

Key Compliance Requirements

  • Register with the Massachusetts Department of Revenue through MassTaxConnect before operating and retain the registration certificate or account confirmation.
  • Confirm whether the city or town requires a local short-term rental license, permit, business certificate, health department registration, inspection, renewal, or local contact designation.
  • Collect and remit applicable room occupancy excise taxes, including the 5.7% state excise and any local option taxes, regional fees, convention center fees, or community impact fees that apply to the property location.
  • Maintain required liability insurance, generally at least $1,000,000 in coverage unless an eligible hosting platform provides equivalent or greater coverage for the booking.
  • Check zoning, condominium, homeowners’ association, lease, mortgage, and deed restrictions before listing.
  • Keep records of bookings, rents, exemptions, tax filings, insurance, inspections, guest communications, and maintenance for audit and renewal purposes.
  • Meet applicable safety expectations, including smoke and carbon monoxide alarms, fire extinguishers, egress, occupancy limits, sanitation, emergency information, and any inspection requirements imposed locally.

Insurance Considerations Before Listing

  • Confirm that the owner’s current homeowners, landlord, or commercial policy allows short-term rental activity; many standard policies exclude business or transient occupancy activity.
  • Obtain at least $1,000,000 in liability coverage or confirm that each platform booking provides equivalent or greater protection.
  • Ask the broker whether the policy covers guest injury, property damage, loss of use, theft, intentional acts exclusions, pet-related incidents, pools, hot tubs, docks, boats, bikes, and off-premises amenities.
  • Check whether the lender, condo association, HOA, or local municipality requires additional insured wording or proof of coverage.
  • Keep certificates, endorsements, renewal notices, claim procedures, and platform coverage summaries in the compliance file.
