Mexico Rules

Short Term Rental Rules and Regulations in Mexico

Executive Overview

Short-term rentals in Mexico are generally permitted, but compliance is layered across federal tax and consumer-protection rules, state tourism and lodging-tax requirements, and municipal licensing, zoning, safety, and housing rules. There is no single national short-term rental rule that applies uniformly in every destination, so owners should verify requirements at the property address before listing and again before renewal, transfer, or a change in property manager.  The practical compliance approach is to treat the property like a regulated hospitality business: confirm whether registration is required, obtain the applicable tax registrations, document local approvals, maintain safety and insurance records, and keep evidence that the listing accurately represents the property and guest rules.

Key Compliance Requirements

  • Confirm local legality before listing: Rules vary by state, municipality, neighborhood, building type, and condominium regime. Some destinations require tourism registration, local operating permits, a visible registration number, or building approvals.
  • Register for taxes: Hosts commonly need a Mexican tax registration and should confirm income tax, value-added tax, platform withholding, and state lodging tax obligations with a Mexican tax adviser.
  • Review zoning, land use, and HOA rules: Verify that commercial lodging or transient occupancy is allowed for the property and that condominium bylaws, homeowner association rules, lease terms, and building policies permit short-term rentals.
  • Maintain safety documentation: Keep records for smoke and carbon monoxide alarms where applicable, fire extinguishers, emergency exits, evacuation instructions, first-aid supplies, gas and electrical inspections, pool safety, and local civil protection requirements.
  • Use accurate guest disclosures: Listing copy should clearly state occupancy limits, house rules, fees, taxes, registration numbers if required, safety features, accessibility limitations, and any neighborhood or building restrictions.
  • Keep renewal and audit records: Maintain a compliance file with registrations, permits, tax filings, insurance certificates, inspection records, guest logs where required, and communications with local authorities or building administrators.

Insurance Considerations Before Listing

  • Confirm the property policy permits short-term rental use and does not exclude business, transient, or paying-guest activity.
  • Obtain commercial or hospitality liability coverage if the standard homeowner policy is insufficient.
  • Review coverage for guest injury, property damage, theft, fire, water damage, hurricane or flood exposure, pool or balcony incidents, and off-platform bookings.
  • Confirm whether the lender, HOA, condominium regime, or property manager must be named or notified.
  • Keep certificates, declarations pages, endorsements, claim reporting procedures, and emergency contact details in the compliance file.

Guest-Facing Website Copy Information

Guest-facing copy should be accurate, transparent, and consistent across the owner website, booking platforms, confirmation emails, and house manual. Include the property location, maximum occupancy, registration number where required, taxes and fees, check-in requirements, safety features, emergency contacts, house rules, quiet hours, parking rules, pool or balcony notices, pet rules, smoking restrictions, accessibility limitations, and cancellation terms.

Owner Checklist

  • Confirm short-term rental legality at the exact property address.
  • Engage Mexican legal and tax advisers before accepting bookings.
  • Collect property title, deed, lease, HOA approvals, and building rules.
  • Register with the appropriate tax, tourism, and municipal authorities.
  • Set up bookkeeping for platform revenue, direct bookings, expenses, withholding, and lodging taxes.
  • Secure appropriate insurance and confirm lender or HOA notification requirements.
  • Approve guest-facing house rules, emergency procedures, and refund policies.
  • Maintain a digital compliance file and calendar for renewals, filings, and inspections.

Host or Property Manager Checklist

  • Verify the listing displays required registration or permit information.
  • Confirm all listing descriptions, photos, fees, and policies match the approved guest-facing copy.
  • Track nights booked, occupancy, tax collection, platform withholding, and any local cap or reporting obligation.
  • Complete pre-arrival guest communications and identity checks where required.
  • Inspect safety equipment before launch and on a recurring schedule.
  • Maintain service logs for cleaning, maintenance, pest control, pool care, and fire equipment.
  • Keep incident reports and guest complaint records in the compliance file.
  • Escalate legal, tax, insurance, safety, or neighbor complaints to the owner promptly.

Launch Sequence

  1. Confirm property eligibility: Review zoning, building rules, HOA permissions, lease restrictions, and local STR requirements.

  1. Run a soft launch: Accept limited initial bookings, test check-in workflows, cleaning turnover, guest communications, and tax reporting.
  1. Review after first stays: Update policies, maintenance routines, pricing assumptions, and compliance records based on guest feedback and operational issues.
  1. Schedule renewals: Track permit renewals, tax filing dates, insurance renewal, safety inspections, and periodic compliance reviews.
